A BILL to amend and reenact §20-2-6a of the Code of West Virginia, 1931, as amended; to amend and reenact §61-7-3, §61-7-4, §61-7-6 and §61-7-11a of said code; and to amend said code by adding thereto two new sections, designated §61-7-4a and §61-7-15a, all relating to carry or use of a handgun or deadly weapon; permitting eligible persons to carry a handgun for self-defense purposes, without permit, while afield; establishing that criminal penalties for carrying a concealed deadly weapon without state license or other lawful authorization applies only to persons under twenty-one years of age; requiring an applicant for a concealed weapon permit be a United States citizen or legal resident thereof, a resident of this state and of the county in which application is made; permitting persons eighteen years and older to obtain a concealed carry permit; requiring actual live firing of ammunition in training; requiring an applicant for a concealed carry permit to provide a copy of instructor’s certification; requiring that on or after January 1, 2017, all duplicate license cards issued by county sheriffs be uniform across all fifty-five counties and feature a photograph of the licensee; requiring State Police, in cooperation with the Sheriffs’ Bureau of Professional Standards, prepare uniform applications for licenses and license cards; creating a provisional license to carry concealed deadly weapons for persons between eighteen and twenty-one years of age; establishing provisional license application requirements and procedures; exempting members of the United States Armed Forces, Reserve or National Guard from permit requirements; eliminating the requirement for persons twenty-one years of age and older to possess a permit to carry a concealed deadly weapon provided that certain conditions are met, including being a United States citizen or legal resident, being twenty-one years of age or older and not prohibited from possessing firearms; requiring a school principal to report certain violations to the State Police; providing enhanced penalties for use of a firearm during commission of a felony;  and excepting enhanced penalties in certain circumstances when a firearm is used in defense of self or others.

What is "Constitutional Carry or SB:347?

SB 347, introduced by state Senator Dave Sypolt (R-14), would recognize your right to legally carry a concealed firearm without the requirement of having to obtain a costly and time-restrictive Concealed Handgun License (CHL). This is a necessary update to concealed carry statutes in West Virginia, allowing law-abiding gun owners the ability to protect themselves and their loved ones. In West Virginia, it is already legal to carry a firearm openly, as long as the individual is not prohibited by law from possessing a firearm. However, under current law, if a firearm becomes covered by a coat or if a woman prefers to carry a firearm for self-protection in her purse, he or she would need to possess a concealed pistol permit.

SB 347 gives you the freedom to choose the best method of carrying, based on your attire, gender and/or physical attributes. Also critically important, this legislation would keep in place the current permitting system so that people who obtain a permit could still enjoy the reciprocity agreements that West Virginia has with other states across the country.

 

Legal Definition:

A BILL to repeal §61-7-3 and §61-7-6 of the Code of West
Virginia, 1931, as amended; to amend and reenact
§20-2-5 and §20-2-6a of said code; and to amend and
reenact §61-7-4 of said code, all relating to creating
the West Virginia Firearms Act of 2015; removing
requirement one must have a license to carry a
concealed handgun; repealing exceptions section of
said code to prohibitions against carrying concealed
handguns without a license and removing exemptions
from licensing fees; authorizing carrying a handgun
for purposes of self defense while in the woods of this
state whether concealed or not; providing that if
findings of fact and conclusions of law of the court
fail to uphold denial of a license, the applicant is
entitled to reasonable costs and attorney’s fees,
payable by the sheriff’s office which issued denial;
defining who is prohibited from possessing firearms
and retaining criminal penalties for violations; and
establishing procedure for sheriff in determining
eligibility for license when license holder changes
home county.

This bill was vetoed by the governor after it passed the WV House and Senate.

This bill will be presented in the 2016 legislative session and I will help fight to get it passed, again!
